These Terms of Use (“Terms” or “Agreement”) apply to www.sourcebooks.com as well as www.bloombooks.com, www.simpletruths.com, www.hometownworld.com, www.bookbash.com, www.123magic.com, and any other website, application, mobile application, or online service owned or operated by Sourcebooks, LLC that links to these Terms of Use (collectively, “Sourcebooks,” “we,” “us,” or “our”) (collectively, the “Sites”), as well as your purchase of any products or services offered through the Sites and your access to or use of any related offerings (collectively, the “Services”).
These Terms set forth the material terms and conditions that govern your access to and use of the Sites and Services. Not all features or services described herein are available on every Site.
BY ACCESSING OR USING THE SITES OR SERVICES, YOU AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT.
If you do not agree to these Terms, you may not access or use the Sites or Services.
Sourcebooks may modify these Terms at any time in its sole discretion. Any changes will be effective immediately upon posting to the Sites. Your continued use of the Sites or Services following the posting of revised Terms constitutes your acceptance of those changes. You are responsible for reviewing these Terms periodically for updates.
As long as you comply with these Terms, Sourcebooks grants you a limited, personal, nonexclusive, nontransferable, revocable license to access and use the Sites and Services for lawful purposes.
1. Who May Use the Sites and Services
The Sites and Services are intended for users who are at least 13 years old. If you are under 13, you may not use the Sites or Services or submit any information to us.
If you are between 13 and the age of majority in your place of residence, you may use the Sites and Services only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf and is responsible for your use of the Sites and Services.
By accessing or using the Sites or Services, you represent and warrant that (a) you are at least 13 years old; (b) you have the legal capacity to enter into these Terms (or your parent or legal guardian has agreed to them on your behalf); and (c) your use of the Sites and Services will comply with these Terms and all applicable laws.
You may not register for an account where prohibited by applicable law.
Parental Controls Notice. Tools such as filtering software are commercially available and may help limit minors’ access to material that may be considered harmful.
2. Your Account and Responsibilities
Some features of the Sites or Services may require you to create an account. If you register, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not you authorized it. You agree to notify us immediately of any unauthorized access to or use of your account or any other security breach.
You may not share your account with another person or use another person’s account without permission. We are not responsible for any loss or damage arising from your failure to safeguard your account credentials.
We reserve the right to suspend or terminate your account if we determine that the information you provided is inaccurate, incomplete, or misleading, or if your account is used in violation of these Terms.
We may disclose account information if we believe such disclosure is necessary to comply with applicable law, legal process, or governmental request, or to protect the rights, property, or safety of Sourcebooks, our users, or others.
3. Suspension or Termination of Access
These Terms remain in effect for as long as you access or use the Sites or Services. You may stop using the Sites or Services at any time. If you have created an account, you may request that we deactivate or delete your account by contacting us using the information provided below. Termination does not affect any rights or obligations that arose before termination.
We reserve the right, in our sole discretion, to suspend, restrict, or terminate your access to all or any part of the Sites or Services (including your account) at any time and for any reason, including if we believe that (a) you have violated these Terms; (b) your use may harm Sourcebooks, other users, or third parties; or (c) we are required to do so by law.
We may also modify, suspend, or discontinue all or any part of the Sites or Services at any time without liability to you.
Upon suspension or termination, your right to access and use the affected portion of the Sites or Services will immediately cease. Any provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, and governing law) will remain in effect.
4. Ownership of Content and Limited License
Our Content. The Sites and Services, including all text, graphics, images, illustrations, audio, video, software, designs, layout, trademarks, logos, and other materials made available through them (collectively, “Content”), are owned by or licensed to Sourcebooks and are protected by copyright, trademark, trade dress, and other intellectual property laws.
Except as expressly permitted in these Terms, you may not copy, reproduce, distribute, republish, download, display, transmit, modify, create derivative works from, or otherwise exploit any Content without our prior written permission. You may not systematically retrieve, archive, scrape, or download Content to create a collection, database, or compilation, whether manually or through automated means. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices.
All rights not expressly granted to you are reserved by Sourcebooks and its licensors.
Limited License to You. Subject to your compliance with these Terms, Sourcebooks grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Sites and Services and to view the Content solely for your personal, non-commercial use.
This license does not permit any commercial use of the Sites or Content or any use of the Content outside the scope expressly authorized in these Terms. Any unauthorized use of the Sites or Content automatically terminates the license granted to you.
Third-Party Content. Some Content on the Sites may be provided by third parties or subject to separate license terms. All such third-party rights remain with their respective owners. Nothing in these Terms grants you any rights in third-party content beyond those expressly permitted.
Use of YouTube API Services. The Sites and Services use YouTube API Services to retrieve certain video-related information, such as video titles, descriptions, and thumbnail images. By using any portion of the Sites or Services that incorporates YouTube functionality, you agree to be bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms.
Your use of YouTube content is also subject to the Google Privacy Policy, available at https://policies.google.com/privacy.
5. User Content and Submissions
Content You Submit. The Sites or Services may allow you to post, upload, submit, or otherwise make available content, including comments, reviews, text, images, videos, social media content, or other materials (collectively, “User Content”). You are solely responsible for the User Content you submit and for the consequences of posting it.
License You Grant to Sourcebooks. By submitting User Content through the Sites or Services, you grant Sourcebooks a non-exclusive, worldwide, royalty-free, fully paid, transferable, and sublicensable license to use, reproduce, distribute, display, perform, adapt, modify, and create derivative works from that User Content in connection with operating, promoting, and improving the Sites and Services, in any media now known or later developed. This license continues even if you stop using the Sites or Services. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate the rights of any third party.
Social Media Submissions. If you tag, mention, or otherwise identify Sourcebooks or one of our brands in social media content, you grant us the right to use that content in connection with our marketing and promotional activities, including on our websites and social media channels, subject to the same license terms above. You represent and warrant that you have permission from any individuals appearing in such content to grant these rights.
Removal and Monitoring. We are not required to monitor User Content. However, we reserve the right, in our sole discretion, to review, remove, edit, or refuse to post any User Content for any reason, including if we believe it violates these Terms or applicable law. We may also disclose User Content if required by law or if we believe disclosure is necessary to protect Sourcebooks, our users, or others. User Content does not represent the views of Sourcebooks, and we do not endorse any User Content posted by users.
No Confidentiality. Unless otherwise expressly stated, User Content is not confidential. Do not submit content that you expect to remain private.
6. Acceptable Use
You agree to use the Sites and Services only for lawful purposes and in accordance with these Terms. You may not use the Sites or Services in any way that violates applicable law or regulation, infringes or violates the rights of others, or is fraudulent, harmful, or abusive.
You may not post, upload, transmit, or otherwise make available any content that is unlawful, defamatory, harassing, threatening, obscene, fraudulent, misleading, or otherwise objectionable. You may not impersonate any person or entity, misrepresent your affiliation with any person or entity, solicit personal information from minors, or use the Sites or Services to promote illegal or unauthorized commercial activity.
You may not interfere with or disrupt the operation of the Sites or Services or any servers or networks connected to them. This includes attempting to gain unauthorized access to accounts, systems, or data; probing or testing the vulnerability of any system; introducing viruses or other harmful code; engaging in spamming or phishing; or taking any action that imposes an unreasonable or disproportionately large load on our infrastructure.
We reserve the right to investigate suspected violations of this section and to take any action we deem appropriate, including removing content, suspending or terminating access, and cooperating with law enforcement authorities. Violation of this section may result in immediate suspension or termination of your access to the Sites or Services.
7. Fraud and Unauthorized Activity
We reserve the right to investigate suspected fraudulent or unauthorized transactions. If we believe fraud has occurred, we may suspend or terminate your account, place orders on hold, refuse future purchases, or take other action as permitted by law.
You are responsible for safeguarding your account and payment information. To the extent permitted by law, Sourcebooks is not liable for losses resulting from unauthorized use of your account, and you may be responsible for losses incurred by Sourcebooks due to fraudulent activity associated with your account.
8. Links to Third-Party Sites and Services
The Sites and Services may contain links to third-party websites, services, or resources that are not owned or controlled by Sourcebooks. These links are provided for your convenience only. Sourcebooks does not endorse, control, or assume responsibility for the content, policies, or practices of any third-party websites or services. Your interactions with third parties, including purchases or agreements you enter into, are solely between you and the third party.
If you choose to access any third-party website or service, you do so at your own risk. We encourage you to review the applicable terms and privacy policies of any third-party site you visit. The Sites or Services may also allow you to connect your account with third-party platforms (such as social media services). Your use of those third-party services is governed by their own terms and policies, and Sourcebooks is not responsible for their actions or omissions.
9. Digital Content License
When you purchase or download any ebook, audiobook, or other digital content through the Sites or Services (collectively, “Digital Content”), you are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Digital Content solely for your personal, non-commercial use, subject to these Terms and applicable copyright law.
Digital Content may be provided without digital rights management (DRM) protection. The absence of DRM does not grant you any ownership rights in the Digital Content and does not permit you to reproduce, distribute, publicly perform, publicly display, sell, share, or otherwise make the Digital Content available to others.
All Digital Content remains the copyrighted property of the applicable author, publisher, or rights holder. Except as expressly permitted by law, you may not transfer, resell, redistribute, or create derivative works from Digital Content.
Free or sample Digital Content is subject to the same restrictions.
10. Purchases and Terms of Sale
If you purchase products or services through the Sites or Services, the following terms apply in addition to these Terms.
Eligibility to Purchase. You must be at least 18 years old and able to enter into a legally binding agreement to make a purchase. By placing an order, you represent that you meet these requirements. We reserve the right to refuse or cancel any order at our discretion, including if we suspect fraud, unauthorized activity, or a violation of these Terms.
Pricing and Availability. All prices are listed in U.S. dollars unless otherwise stated. Prices, product descriptions, and availability are subject to change at any time without notice. We make reasonable efforts to display accurate pricing and product information, but errors may occur. If we discover an error in pricing or availability after you place an order, we reserve the right to cancel or correct the order and issue an appropriate refund if necessary.
Payment Authorization. By submitting an order, you authorize Sourcebooks or its designated payment processor to charge your selected payment method for the total purchase amount, including applicable taxes and shipping fees. You represent that you are authorized to use the payment method provided. If payment cannot be processed, we may cancel your order. You are responsible for any applicable sales, use, or similar taxes associated with your purchase. If you are experiencing trouble with your purchase, please contact us.
Delivery. For physical products, title and risk of loss pass to you upon delivery to the carrier. Delivery dates are estimates and are not guaranteed. For digital products or services, delivery is deemed complete when the product or service is made available to you or to your designated recipient (including by download, streaming access, or account access), regardless of whether you access or use the product or service. Once delivery has occurred, our obligation with respect to that product or service is satisfied.
Returns and Exchanges. If you receive a damaged, defective, or incorrect physical product, please contact us for a return authorization within fourteen (14) days of receipt to request return authorization. No returns or exchanges will be accepted without prior authorization.
Sourcebooks offers a thirty (30) day return period for physical books or products purchased through the Sites. To be eligible for a return, you must contact us to request a return authorization within thirty (30) days of receipt and comply with our return instructions. Returned products must be received and inspected before any refund or exchange is issued.
Unless otherwise required by law, you are responsible for return shipping costs, original shipping charges are non-refundable, and refunds will be issued only after returned products are received and processed. Digital products, including ebooks, audiobooks, downloadable content, and apps, are non-returnable and non-refundable once access has been provided. Except as expressly stated in this section or required by law, all sales are final.
Promotions and Additional Terms. Certain products, services, promotions, or features may be subject to additional terms. In the event of a conflict between these Terms and specific terms applicable to a promotion or product, the specific terms will control with respect to that offering.
11. Privacy and Communications
Your use of the Sites and Services is also governed by Sourcebooks’ Privacy Policy, which describes how we collect, use, and share your information. The Privacy Policy is incorporated into these Terms by reference and forms part of this Agreement.
By using the Sites or Services, you consent to the collection and use of your information as described in the Privacy Policy. You understand that communications over the Internet are not completely secure. Although we take reasonable measures to protect information transmitted through the Sites, we cannot guarantee the security of any information you transmit to us. Any transmission of information is at your own risk.
By using the Sites or Services or sending communications to us electronically, you consent to receive communications from us electronically, including notices, disclosures, and other information related to your use of the Sites or Services.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SOURCEBOOKS AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITES, SERVICES, OR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SOURCEBOOKS AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND SUPPLIERS FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITES OR SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SOURCEBOOKS FOR THE APPLICABLE PRODUCT OR SERVICE, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Sourcebooks and its affiliates, licensors, service providers, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or related to: (a) your use of the Sites or Services; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any law or the rights of a third party.
Sourcebooks reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claims.
14. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to your access to or use of the Sites or Services will be governed by the laws of the State of Illinois, without regard to its conflict of laws principles. Except as otherwise required by applicable law, you agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Sites or Services must be brought exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to the personal jurisdiction of those courts.
If you are a consumer residing in the European Union, you may bring a claim in the courts of the country where you reside, to the extent required by applicable law.
Any claim arising out of or relating to these Terms must be brought within one (1) year after the cause of action arises, or the claim will be permanently barred, except where prohibited by law. Before filing a lawsuit, the parties agree to attempt in good faith to resolve any dispute informally. If the dispute cannot be resolved within thirty (30) days after written notice of the dispute is provided, either party may pursue any remedies available under applicable law. If Sourcebooks prevails in any action arising out of your violation of these Terms, we will be entitled to recover our reasonable attorneys’ fees and costs to the extent permitted by law.
15. Copyright Infringement Policy (DMCA)
Sourcebooks respects the intellectual property rights of others and expects users of the Sites and Services to do the same. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”).
If you believe that your copyrighted work has been copied and is accessible through the Sites or Services in a way that constitutes copyright infringement, you may submit a written notification to our designated agent that includes the following:
- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest;
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved);
- Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it;
- Your contact information, including your address, telephone number, and email address;
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

16. Miscellaneous

Product Safety Information. Information regarding product safety and regulatory compliance, including information related to the Consumer Product Safety Improvement Act (CPSIA), is available at Sourcebooks' CPSIA.
Force Majeure. Sourcebooks will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, power failures, supply shortages, governmental actions, or interruptions in Internet or telecommunications services.
Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
Waiver. Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision.
Entire Agreement. These Terms, together with our Privacy Policy and any additional terms applicable to specific products or services, constitute the entire agreement between you and Sourcebooks regarding your use of the Sites and Services and supersede any prior agreements or understandings.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms at any time without restriction.
No Third-Party Beneficiaries. These Terms do not confer any rights or remedies on any third party except as expressly stated.
Export Compliance. You may not use or export any Content or Services in violation of applicable export control laws or regulations.
Headings. Section headings are for convenience only and do not affect interpretation.
